Dearie worked in the Appeals Division from 1971 to 1974, the General Crimes Section from 1974 to 1976, the Criminal Division from 1976 to 1977, and briefly as the Executive Assistant United States Attorney for the District in 1977.
He practiced law in private until 1980 before becoming the Chief Assistant United States Attorney in 1982.
President Ronald Reagan selected him as the United States Attorney for the Eastern District of New York. He served from 1982 to 1986 before being appointed to the federal bench on the nomination of New York Senator Al D’Amato.
On February 3, 1986, President Ronald Reagan nominated Dearie to the United States District Court for the Eastern District of New York, filling a vacancy created by 98 Stat. 333.
On March 14, 1986, he was confirmed by the United States Senate and received his commission on March 19, 1986. From 2007 until 2011, he was Chief Judge.
On April 3, 2011, he was promoted to senior status, and in March 2013, he was succeeded by Judge Pamela K. Chen. Dearie remained an active judge on the Eastern District Court, and according to a court spokesman, he plans to retire at the end of 2022.
On July 2012, Supreme Court Chief Justice John Roberts named Dearie to the United States Foreign Intelligence Surveillance Court for a seven-year term.
