Scherer gave the jury instructions in court on Wednesday morning. During the jury’s deliberations, they were locked up.

Cruz will receive a life sentence without the possibility of parole if the jury does not unanimously recommend that he receive the death penalty.

If the jury does recommend execution, Scherer will have an ultimate say and may decide to impose Cruz’s death sentence or give him a life sentence.

To recommend execution, all 12 jurors must concur on the following: First, the state must have established beyond a reasonable doubt that there was at least one aggravating element and that it was significant enough to support the possibility of the death penalty.

Then, all jurors would have to concur that the aggravators outweigh the mitigating factors. Last but not least, even if the jury agrees with those points, they still need to decide that Cruz should be executed unanimously.

The jury will take these issues into account for each of the 17 murder charges. If the jury is split on whether to sentence Cruz to death on any count, Cruz would be sentenced to life in prison.

Lynda Cruz questioned her son about whether or not his Father’s yelling had upset him.
